Oomomo Rewards - Terms & Conditions

Please read these terms and conditions of participation in the Oomomo Rewards Program carefully. By participating in this program, you (and if applicable your parent or legal guardian on your behalf) agree to be bound by the terms described herein and all terms incorporated by reference. if you (and if applicable your parent or legal guardian on your behalf) do not agree to all of these terms, do not participate in this program.

The Oomomo Rewards Program is a loyalty program (the “Program”) administrated by Oomomo Club, which is a division of Oomomo Canada LTD. (“Oomomo”, “we”, “us”, “our”). The Program is offered to its customers residing in Canada who are 14 years of age or older. If you are under the age of majority, you may only enroll in this program with the consent of your parent or legal guardian. Please be sure your parent or legal guardian has reviewed and discussed these Terms & Conditions with you. This program is available through participating retail locations operating under Oomomo Canada LTD. Membership to the Program (“Membership”) is limited to individuals only and is limited to one account per individual. Membership is not available to businesses and organizations, charities, partnerships, enterprises or anyone other than an individual. Oomomo Canada LTD. reserves the right, without limitation, to terminate, limit, modify, or cancel the program at any time, with or without notice.

You can become a Member by (i) completing the registration process online at www.oomomostore.com (“Program Website”) or (ii) by submitting a paper application through a participating retail location operating under Oomomo Canada LTD. Membership is free and no purchase is necessary to open an Oomomo Rewards Account (“Account”). To participate, you must be a Canadian resident, 14 years of age or older, and must obtain the consent of your parent or legal guardian if you are under the age of majority and such consent is a requirement in the jurisdiction of your residence. Name, valid and unique phone number, and email address are required to open an Account.

If the Member’s information changes, the Member must update the records on their Account. Oomomo Canada LTD. is not responsible for any consequences attributable to the Member’s failure to update their information. Please note that updates are not affected immediately and the Member may not be able to redeem any Points until such time the update takes effect in Oomomo’s systems.

Members earn ten (10) Oomomo Rewards point (“Point”) for every one (1) Canadian dollar spent rounded to the nearest dollar (exclusions apply) in retail stores or on the Program Website. Points are not earned for the following: purchase of Oomomo gift cards, applicable taxes and fees, points redemption portion of a transaction, Post Office products/services, Oomomo Café items, or other products/services specified as exclusions on occasion. Points may be issued when a purchase is made with Oomomo gift cards. For in store purchases, the Member’s physical Oomomo Card must be presented to the cashier before the qualifying purchase transaction is completed. The Oomomo Rewards Program is not applicable to online purchases through Oomomo’s Online Store.

To “redeem” means to use your Oomomo Rewards points to pay, or partially pay, for eligible purchases by using your Card at the point of sale in participating retail locations. You may redeem the Oomomo Rewards points you earn for eligible purchases, or for any other purposes of which we may advise you from time to time. You must redeem a minimum of 100 Oomomo Rewards points at a time, which are worth $0.1 in rewards. If you wish to redeem more than 100 Oomomo Rewards points at one time, you must redeem them in increments of 10 Oomomo Rewards points. A Member’s Points balance will be reduced by the number of Points redeemed during a transaction. Unredeemed Points plus any Points earned in the current transaction will remain in the Member’s account and can be applied to a subsequent transaction. Points have no cash value and are not exchangeable for cash. Points cannot be sold or purchased. Points are void if sold for cash or any other consideration. To redeem your points, the physical Oomomo Rewards Card must be presented to the cashier at the time of redemption.

No returns or exchanges will be accepted unless the product is defective. The original receipt of the defective product must be presented in order to process any exchanges or returns from a transaction that originally earned Points. Oomomo Stores reserve the right to refuse any exchanges or returns without a physical Oomomo rewards Card or a form of proper identification. If you return a purchase, your Oomomo Account (“Account”) balance may be reduced by the number of points earned for that purchase at our sole discretion. If a refund or correction is applied to your Account, your Account balance will be adjusted accordingly by the number of points related to the refund or correction, as applicable, and your Account balance may become negative.

You have 12 months before your Oomomo Rewards points expire if there has been no activity in your account - meaning you haven’t earned, redeemed, transferred any points.

The Program and its benefits are offered at our sole discretion. We may, at our discretion, cancel, modify, restrict or terminate these Program Terms, the Program or any aspect or feature of the Program at any time without prior notice, even though such changes may affect the value of rewards or benefits already accumulated or earned and/or the ability to redeem accumulated rewards or benefits. If a Member does not maintain an active status for 24 months, meaning you haven’t earned, redeemed, transferred any points, the Member’s Oomomo Rewards Account may be deactivated at its sole discretion. All accumulated points associated with the Account will be forfeited and cannot be reinstated. We may, at any time, suspend or cancel your participation in the Program if we believe you to have abused any Program privilege, failed to follow these Terms and Conditions, or made any misrepresentation to us or to any entity associated with participating in the Program. In the event that your participation in the Program is cancelled, all accumulated Oomomo Rewards points in your Account may also be forfeited and removed from your Account. You can cancel your Membership at any time. In order to cancel your Membership, please send an email to us at rewards@oomomostore.com with your full name, phone number and the reason of your Membership cancelation. If you cancel your Membership, you will no longer earn Points and you will forfeit your unused Points & Rewards.

By enrolling in the Program, you will automatically receive Program-related emails or text messages, including Program marketing emails, information about your Oomomo Account, rewards and benefits and other marketing communications from Oomomo Canada LTD. You may opt out of the marketing emails at any time.

Enrolment in the Program constitutes acceptance of these Terms and Conditions and each applicant with membership to the Program consents to the collection and use of personal information in accordance with the Oomomo Canada LTD’s privacy policy, as amended from time to time. Oomomo shall maintain the privacy, security and integrity of all personal information collected from Members, such as but not restricted to: name, address, telephone numbers, email addresses, date of birth and purchasing information. Such information may be used by Oomomo for purposes of administering rebate programs and contests, to better develop our relationship with you, and to develop products that may be of interest to you.

To prevent yourself from being a victim of membership card fraud, please report a lost card immediately. Once Oomomo Club is made aware of a lost Physical Card, it will flag the card as lost in the system and the applicable Account. Oomomo Club may, at its sole discretion, issue a new Physical Rewards Card to you. Your points balance will be transferred to the new replacement card based on the last system record. Oomomo Club is not responsible for any points lost due to the loss of any Oomomo Rewards Card.

Oomomo makes no warranties or representations, either expressed or implied, with respect to type, quality or fitness of goods or services provided through the Program.

Oomomo is not responsible for: (i) any loss or misdirection of, or delay in receiving, any Member application, correspondence, redemption requests, Redemption Rewards or Member benefits; (ii) theft or unauthorized redemption of Points or Redemption Rewards or use of a Redemption Reward; (iii) any acts or omissions of third parties; or (iv) any errors published in relation to the Program, including, without limitation, any pricing or typographical errors, errors of description, and errors in the crediting or debiting of Points from Member Accounts. Oomomo reserves the right to correct, without notice, any errors.

All interpretations of these Program Rules regarding membership are at Oomomo’s sole discretion, and Oomomo’s decisions will be final.

Oomomo’s waiver of any breach of these Program Rules by any Member will not constitute a waiver of any other prior or subsequent breach of these Program Rules. Oomomo’s failure to insist upon strict compliances with these Program Rules by any Member will not be deemed a waiver of any rights or remedies Oomomo may have against that or any other Member. Oomomo may waive compliance with these Program Rules at its sole discretion and may run promotions on occasion that provide enhanced benefits to select Members.

Neither Oomomo Canada LTD, nor our parents, subsidiaries, affiliates, partners, licensors, franchisees or licensees, and each of their respective directors, officers, employees, and agents make any representations, warranties or conditions of any kind whatsoever, express or implied, in connection with these Terms or the Program or any of the rewards, benefits, or points associated with the program including, but not limited to, warranties of merchantability, non-infringement or fitness for a particular purpose, except to the extent such representations and warranties are not legally excludable. In no event will Oomomo Canada LTD, its parents, subsidiaries, affiliates, partners, licensors, franchisees or licensees, and each of their respective directors, officers, employees, and agents be liable for any direct, indirect, special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with the Program, these Program rules, or Oomomo’s operation of the Program. If you have a dispute with us or are dissatisfied with the Program, termination of your membership in the Program is your sole remedy. We have no other obligation, liability, or responsibility to you.
